Terms of Service

1. Agreement
These Terms govern access to the CapHound website and, together with the executed Master Service Agreement (“MSA”) and Order Form, the CapHound service. Where the MSA conflicts with these Terms, the MSA controls for the service.
2. The service
CapHound provides AI-spend attribution, governance, and enforcement for business customers. Access is provisioned by CapHound to authorized customers; there is no public self-signup.
3. Acceptable use
Customers will not: (a) use the service unlawfully; (b) attempt to breach tenant isolation, access another customer’s data, or probe or scan our systems without written authorization (see our responsible-disclosure contact, security@caphound.ai); (c) resell the service without authorization; or (d) place prohibited personal or special-category data into tags or metadata.
4. Customer data & privacy
Our handling of data is described in our Privacy Policy and Data Processing Addendum. CapHound does not store AI prompt or response content. Customers retain ownership of their data.
5. Fees
Fees are set in the Order Form. Taxes are excluded unless stated. Non-payment may result in suspension as set out in the MSA.
6. Warranties & disclaimers
The website is provided “as is.” Service warranties, service levels, and remedies are defined in the MSA. To the maximum extent permitted by law, CapHound disclaims implied warranties for the public website.
7. Limitation of liability
To the maximum extent permitted by law, CapHound’s liability arising from use of the website is limited as set out here; liability for the service is governed by the limitation-of-liability section of the MSA.
8. Termination
We may suspend or terminate website access for breach. Termination of the service is governed by the MSA.
9. Governing law & changes
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules; venue lies in the state and federal courts located in Colorado. We may update these Terms and will revise the “last updated” date above; continued use constitutes acceptance. Contact: legal@caphound.ai.
